CBP was trying to charge an incoming person for wiping their phone
while in line at customs. Not sure what they can charge them with,
except to create a nuisance, missed flight, inconvenient requirement to
appear.

I could imagine scheduling a court appearance, refusing the defendant
entry into the US, then judging by default and issuing a warrant.

I'm waiting for AI to be able to make a social media profile on Facebook
and Twitter than have nothing to do with me.

1) Regardless of your legal status in the US, you are still protected by the 4th and 5th amendment protection while on US soil. So, unless the Supreme Court backtracks on decades of precedence the US better be prepared to open the purse strings AGAIN....

a. I can see them trying to file charges for obstruction, destruction of evidence, etc... However both "should" fail due to ICE/CBP not having a legal right to such "evidence"..

I don't know where you are coming from. I have been absent for a few days.

Deportation(s) happen with Article 2 judges. As you know Article 2 is under the presidents purview. The Constitution and Congress gives him that power.

The "legal" process under Article 2 and 3 are different.

Article 3 cases sometimes take months and even years to resolve... where as Article 2 cases can take minutes, sometimes days.

It's reported that ~ 70% of the cases where ICE has detained and deported people they have already been adjudicated and have had their removal orders.

I'll say it an other way... They have had their due process already.

This begs the question... What about the other 30% ... simple... If you are around one of the 70% when they get arrested you might be deported. Like I said above Immigration court is WAY different than the Article 3 legal court(s).

All are covered under the 4th and 5th Amendments... unreasonable government searches and seizures and protection against self-incrimination.

When ICE heads out for the day they aren't just knocking on doors looking for Illegals they have a list and they know where you are.

And if Abuela (Grandma) who is illegal and happens to be beside their target you will become a statistic... The 30%.

There is a slight fix for this... If a Democrats/Sanctuary State or City arrests an illegal who rapes and murders people they should hand them over to ICE and not have ICE go out looking for them.

He made it sound like ICE is walking down the street just kicking doors down.

When ICE heads out for the day to round up some illegals they have an idea who and where they are... And warrants are in hand.

BTW, here's something new that came out the other day... Friday I think... The TSA will be in communications with ICE with lists of people on the flights.

So... If you are illegal ICE may round you up as you are getting off the plane.

Citizens are not getting deported...

I hear you... There are no, or little to no, infractions of someone's constitutional rights being tampered with.

Like I said in the prior message if ICE went out with a list of 100 names in the morning and they came back with 200 people just means that 100 were in the wrong place at the wrong time.

This doesn't mean that you get off Scott free because of that... It just means you are more than likely going back to your country of origin.

You have to do things by the book if you want that crime to be the crime that aides in her deportation.

And she was later deported... because they followed the law and the process.

I doubt that anyone's rights have been violated. The media has nothing to lose by lying about such a thing because there's no way to prove them wrong (or right.) "Sources say.."

A couple things that the media omits come to mind:

1. Permanent residents are held to a higher standard than citizens when it comes to law enforcement BUT..

2. There is still some tolerance, and you can actually still renew your green card after an arrest. The ALJs know the difference between a total POS and a person who made a little mistake.

But the media has a boner for the power they have over people who don't know these things.
